    Default Rooommate Wants Her Sex Offender Boyfriend to Help Her Move

    My question involves criminal law for the state of: Oregon
    My former roommate is now demanding that I let her bring her sec offender boyfriend onto the propety to help her move her stuff.. lol.. it is his stuff she tried to sneak him on property by moving all his crap here ( 5 cubic meters of clothing and shoes.. I am still baffled)
    I told her if he put a foot on property I would call the police. She says whatever..and that she is going to do it..and there is nothing the police can do.. However,,, I have witnessed him violate his parole numberous times... from drinking alcohol.. and referring basketballs games at most fo the metro areas high school gyms... this street is teaming with young girls..and he is to not have any contact with minors under 14.. is that enough to get him hauled off?
    Conftonation is imminent.. hope to hear from someone soon.. his parole officer is keep too tight of lips.. I think there is nothing she can do.. I have found his pay stubs from the referring games.. and some of them are for 4 and 5 graders.. can I give those to her.. or is that fruit from the poisned tree.. a phrase my father popped off at me (too much law and order I guess)

    So? Exactly what are you expecting the police to DO? Unless the property in question is statutorily off limits to REGISTERED sex offenders, or until there has been a trespass warning issued, he's not doing anything illegal just by being there.

    Yep...pretty much.

    Then I guess you should have reported those incidents at the time?

    It's enough to file a police report, and possibly to start an investigation on probation violation - but doubtful that your statement alone is going to make any difference about what happens today.

    Fruit of the poisoned tree applies to evidence collected by the state, not by private citizens. If you have evidence of his violation, then forward it to his probation officer (however keep in mind that technically you are in possession of his property which could open the door for theft charges against YOU depending on the circumstances).

    The sooner you let them get their stuff out the sooner you'll be rid of them - but the bottom line is that unless of until his PO violates him, police are going to wave and say "have a nice day moving your stuff".

    Ouch.. that really hurt! I spoke to a senior legal aid lawyer, and she pretty much said the same.. she did say that we could be morally responsible for informing the organizations where he referee's such as high schools and Blazer outreach games where there are youngsters and the latest one if for Special Olympics.. 2 big whamo violations
    Thank you for your help.. it will kill me to let him on the property.. however, my father solved that issue and moved the belongings out to the garage in a very respectful manner , we do not want to give them anything to use against us.

    I find it funny that while you knew he was refereeing these games, violating his parole in all these ways, you chose to do nothing about it until you and your roommate had a falling out.

    So much for keeping the kids safe.

    Actually.. I had no knowledge of what his crime was.. heck.. I had no knowledge that he was a con. It was during our move into the house.. that first it came out.. that he couldnt be on the lease.. then he was framed.. but no informaiton give.. which ticked me off.. in a different life in a different time.. I worked as a clerk at LA County probation.. and figured that I could get the information from folks like you.. the court clerk.. and whamo.. that night.. he was informed he was not permitted on the premise.. and then I began my long arderous serch to determine what I could do. Who he worked for... etc.. That is why I was speaking to my friend about him.. when she told me that he refereed games at her daughters high school.
    So no I am not a manipulative person.. just worried about karma.. and legal liability. I have however, contacted the person in charge of Blazers street jams/ special olympics. .and doing what the lawyer stated the morally right thing. The thing that really burns me is that I knew this woman for 13 years.. he popped up 6 years ago.. and I have no clue that he was never on the lease.. and that place was crawling with young kids. His parole officer stated that it was a concern of hers... but she never did anything. the manager was a friend of mine.. but we never spoke of him.. and the lawyer said that when a registered sex offender moves into yourneighborhood you get a flyer.. i neve got a flyer... and I have checked (today) he is not on any of the state of Oregons websites.. does that mean he is not a priority sex offender? I thought if you register. then you are? god so confusing. The only thing I found on him was on criminalcheck.com.. not state or federal sex offender sites,, anyone know why?
