    Default Felony Drug Probation Violated While Unsupervised

    My question involves criminal law for the state of: tn my friend has been on probation for drug charges for 8 yrs. the last 4 yrs unsupervised.he was charged with sale of schedule 2 but he was only present in the house when the sale happened.1 mth before getting off unsupervised he was violated for the new charges.now he has been in jail 2 mths and the judge will not let him out until the new charge is resolved.how can the judge hold him?should he not do time for the violation and get out until his trial?can he be charged for a sale if he was only in the house and was not involved in the sale?

    You say he was violated for getting charged with a new crime. He's probably now serving his sentence for the violation.

    If he thinks he can prove he wasn't a participant in the drug dealing, he and his lawyer have the right to take his new case to trial.
