My question involves landlord-tenant law in the State of: CA
Hi. We just found out our sublessor has defaulted on the Master lease; nobody told us and the owner continues to collect rent from us (per the sublease) for the business premises. We don't know when the sublessor stopped paying, but we were told it has been "several months". We've been in the space for a year and have 2 more on the sublease. We want to get out of the sublease, as business is not doing well, and the neighborhood isn't very safe. Anyway, can we break the sublease after our "landlord", the master tenant broke the master lease? We don't have a separate agreement with the owner, but they have authorized the sublease. Also, the original tenant took off and did not authorize our sublease originally; does this make our original agreement void? Her name is on the master lease as both co-lessee and tenant, but she did not approve anything. We really want out without getting sued, but don't know if these constitute grounds to get out legally.
We are in CA. Any help is greatly appreciated.
