My question involves a traffic ticket from the state of: California
I was recently ticketed by a CHP Officer for CVC 21461(a). I was merging onto a freeway onramp that eventually turns into an exit only lane. It was the middle of rush hour and i was putting my attention into merging. By the time i was able to merge, i had passed a sign that stated right lane must exit. I had my blinker on the whole time and i never executed any unsafe move.
The text of the code i was cited for indicates that the code cannot stand alone as an enforceable traffic offense; some other vehicle code provision or local traffic ordinance must be proven to have been violated for a person to be guilty of violating 21461(a). From what i have found in my research, police officers generally use this code as a catch-all when they cannot remember the specific code that was violated.
I am in the process of writing my case and am looking for a cvc that relates to safely merging onto a freeway. Anyone know of one?
