    Default Stealing From Employer By Faking Merchandise Returns

    My question involves criminal law for the state of: California

    A close friend of mine got caught stealing from his employer. He once took an old receipt and refunded the money back to his card without returning the merchandise. This totaled $150. He was caught after leaving the employer and was contacted via telephone by the local police department after several attempts by the employer to contact him. I have a few questions... If anyone could help it would be greatly appreciated!

    1. Since everything was caught on tape, would it be best for him to come clean?

    2. What type of punishment is he looking at?

    3. The police want him to come down to the police station now.... why? Will he be arrested and then taken to jail?

    4. What $ amount would take this crime to the next level?

    That is a decision he and his Attorney should make
    2. What type of punishment is he looking at?
    Depends on charge if you know the penal code of which he is charged that will help
    3. The police want him to come down to the police station now.... why? Will he be arrested and then taken to jail?
    Cant say for sure but I am guessing so he can be booked and processed
    4. What $ amount would take this crime to the next level?
    Depends on charge

    My friend ended up getting charged for Burglary. Here are my last questions:

    1. How could he be charged for burglary if the total was $150?

    2. Should I wait for him to be released on O.R.? Should I bail him out?

    Please advise...

    Dollar value has nothing to do with why he was charged with buglary. Without details we cant speculate. If he gets OR there is no bail. Bailing him out (if needed) is your decision not ours
