My question involves adoption law for the State of: Minnesota

My (step) daughter's bio-dad, who sees her maybe once a year (he lives in FL) and only pays child-support because it's garnished, opposes me adopting her. My wife received full custody when the case was brought to the MN court system (he didn't show up). He also has not met his agreements (outlined in the divorce agreement) to pay for her insurance and half od her unreimbursed medical expenses (to the tune of about $12,000.00).

My daughter will be 12 in August.

Is my adopting her a possibility? Or do I need to wait until she's 18?
