My question involves employment and labor law for the state of: Massachusetts:
I am classified as an exempt emplyee and I do perform exempt duties more than 50% of the time, and I am paid on a salary basis.
The company I work for is under contract to the Department of Labor.
During my first six months of employment I regularly worked 50+ hours per week with a perfect attendance record. Then, I asked my supervisor if I could come in two hours later on a Wednesday morning due to my having a doctor's appointment, she refused stating:
"It's company policy that salaried employees must make up time off in the same day. You will have to stay two hours later on Wednesday in order to get your eight hours pay."
I was required to use vacation time for this two hour appointment, despite the fact that I had worked three extra hours on Monday and two extra hours on Tuesday.
This contractor has 20 locations across the US. This is the corporate "time-off" policy for exempt employees in MA. Is this legal?
