My question involves criminal law for the state of: Washington.
I need to know what the law is regarding Drug Possession charges in Washington State. My husband has been on probation for almost a year and recently tested positive after a UA given by his new probation officer. He didn't drive his truck to check in so they had nothing to search but him. He had NOTHING on him, no drugs, no paraphenelia, they found nothing. They charged him with 2 violations. 1) Possession of a controlled substance and 2) Consuming a controlled substance. Each carried 60 days in jail so he was given 120 days. Is it legal to be charged with possession when he had nothing with/on him? He only had a positive UA that was given 7 days before. He was told that the drugs in his system counted as possession.
