    Default Previous Owner's Stuff and Shady Realtor

    My question involves real estate located in the State of: Oregon

    This will sound bizarre - but sadly I'm sure that this has happened before.

    My realtor claims that he owns 2 cars that are on my property that I have owned for 2 entire months - 60+ days - about 7-8 weeks.

    He claims that the previous owner said that he could have them - I don't necessarily dispute that although he is IMO a proven liar.

    I have been evicting a tenant for quite some time and now that it has been successful the realtor (dual agency) feels that he can come onto my property and retrieve the previous owner's property for himself and friends.

    My position is that the previous owner's time frame for retreiving their property has (long) expired and that the realtor can go fly a kite. He is coming tomorrow to get what he says is his property and I am going to inform him that his other client's property (and thus his) is forfeit and that he is trespassing. - am I wrong in my position?

    Just so you know these aren't vintage porsche here - they are heaps haven't been registered in decades and have a real value of less than it cost to have them occupy a space for a week - it is just the principal of not being taken advantage of and the further use of my property as a storage lot that I am interested in.

    Any advice would be appreciated!

    Do you want the stuff? If not, give him a deadline to take it all. If so, demand evidence of his claim of ownership. Although I have not yet looked into Oregon law, typically after closing, any person property left by the seller on the real estate becomes the property of the new owner.

    Thanks for the quick response.

    I looked at it like you said and decided that despite my feelings about getting walked on that it was in my interest to let him just take them after telling him what I thought about a couple of things. They were removed immediately and he also agreed to provide a dumpster (and maybe labor) for cleanup - which will be a nice bonus if it happens - I'm not holding my breath.
