    Default Sending Home Employees Early

    My question involves employment and labor law for the state of: Illinois.

    Hello-

    I am a manager of a business in Illinois and am responsible for the scheduling of several hourly, part-time employees, mostly high school and college kids. Everyone always wants more hours, but when business is slow we often end up overstaffed.

    What are the laws in Illinois for sending employees home before the end of their scheduled shift? By which I mean: are we allowed to do this? Or are we only allowed to ask? Is there a minimum percentage of their scheduled shift for which they must be paid?

    In all 50 states, an employer may legally send home employees for whom they have no work. There is no state where they are only permitted to ask; in all states they may order. (It would be nice of you to ask for volunteers first but you are not required to.)

    There is a small handful of states that have what are called reporting pay laws which require that you pay a minimum of x hours if the employee is sent home before the end of their scheduled shift. However, IL is not one of them; you owe the employees only for the time actually worked.
