    Default Class C Misdemeanor in Texas

    My question involves expungements or pardons for the state of: Texas.

    I was convicted of a Class C Misdemeanor Assault at (4 months after I turned) 17 y/o in 2005 and I spent a day or 2 in jail (serving the fine). I am now 20 years old and I haven't committed any crimes 3 years later. From what I read, I'm pretty sure it cannot be expunged, but I was wondering if it could be sealed or something else to that effect. Thanks for all of your help!

    Texas is not know for it's willingness to expunge the records of law breakers.

    Were you tried as an adult? What was the charge?

    If it wasn't automatically sealed at 18, you may have to look for a pardon.

    Yeah, Texas is pretty rough on the law breakers.

    I'm assuming I was tried as an adult since I pled guilty and had to "big boy jail."

    If you commit a crime after you turn 17, Texas prosecutes you as an adult.

    Your sentence does not appear to have been deferred, so you would have to get a pardon before you are eligible for expungement.
