    Unhappy Tried to Give Police False I.D.

    In FL after tough year, week & day, wearing seatbelt, driving speed limit and using turn signal, pulled over. When asked for DL & Reg, I asked why pulled over 3 times when he finally told me he would tell me in a minute. He asked my name when I told him didn't have with me. Stupidly I gave him neighbors name, but didn't know middle name. A bad liar I admitted who I was and didn't have lic. (siezures). Arrested for giving false id. Wife shows up (live down the street) and he starts yelling at her inc'g I'm an alcoholic. No idea where that came from. No alcohol on breath or in system. Yelling at me all the way to jail that if I'd just told him no lic., ticket & no arrest. & wasting his time. I didn't know, this has never happened before. What are penalties?
    early 50's, no record/tickets in FL over 6 yrs. 3 misdemeanors in life, really stupid thing I did -- Thanks for any help you can give (for a moment of moronic stupidity)

    I'm guessing these are the minimal charges you're facing:

    843.03 Obstruction by disguised person.--Whoever in any manner disguises himself or herself with intent to obstruct the due execution of the law, or with the intent to intimidate, hinder, or interrupt any officer, beverage enforcement agent, or other person in the legal performance of his or her duty or the exercise of his or her rights under the constitution or laws of this state, whether such intent is effected or not, shall be guilty of a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.



    322.34 Driving while license suspended, revoked, canceled, or disqualified.--

    (2) Any person whose driver's license or driving privilege has been canceled, suspended, or revoked as provided by law, except persons defined in s. 322.264, who, knowing of such cancellation, suspension, or revocation, drives any motor vehicle upon the highways of this state while such license or privilege is canceled, suspended, or revoked, upon:

    (a) A first conviction is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.


    For the second degree misdemeanor, you could face up to 60 days in jail. For the first degree misdemeanor, up to one year in jail. Be very thankful that there was no accident or injuries (driving and seizures do NOT mix) otherwise you could be looking at felony time of years in prison instead of a little time in the county jail.

    They are not minimal to me. I had to spend approx. 24 hrs. in jail all because of the time it took them to process me and also I had to be taken to the emergency room. They are clearly very busy there with some very scary people. I had never been to jail before and it scared the hell out of me. A little more on what happened that req.'d ER treatment at the bottom for anyone interested.

    I am in none of these classifcations. I simply don't have a license out of concern for the safety of others, my family and myself (see bottom).

    I have not had a seizure in 5 years, however, since Drs. still don't know the cause of these "benign" seizures, I don't want to take the chance of resuming normal driving. And yes, I am thankful. I drove about 2 miles round trip under very unusual circumstances. Wasn't the cop supposed to have some sort of cause for pulling me over in the first place? Going to jail for any time would be life threatening. (see botttom)


    Okay- the bottom
    Over a decade ago I was in a very bad MVA (someone else's fault.) I spent two weeks in a coma on life support. They gave me very little chance of survival and also gave me experimental drugs. It is amazing that I survived, but I went home 2/12 months later with heavy consequences. I have major and permanent lung and organ damage. I also have inoperable herniated discs and live in constant pain, but it's better than dead. I used to have seizures with no warning and still could as they have never been able to find the cause. I look relatively normal, but if I were to contract something major such as pneumonia or a staph infection, it is almost certainly fatal. In jail, being treated as normal despite my requests, I sweated enormously. Passing out, I was ambulanced to ER where they found me with my blood pressure through the roof, my electrolytes way off and very dehydrated. From what I'm told, I woke up about an hour later. Not looking for anything except how best to handle this event my stupidity caused. Cheers all

    My question involves criminal law for the state of: Florida
    I'm pretty much w/o understanding, but I've done something stupid, but far less serious than what I'm being charged with. Please see false id for more.

    I didn't mean "minimal" in the sense that the charges were inconsequential - I meant minimal in the sense that you were likely facing at least those two charges (what the police arrest you for and what you actually get charged with in court can be different things). Best way to handle is to get the best criminal defense attorney you can find and let them fight it out for you. It's possible that if you end up having to do time that they'd put you either in a medical wing or maybe on something like house arrest with an ankle monitoring device.

    And I am not sure I would use the "I didn't have a license when I was driving because I don't think it is safe for me to drive" defense.

    Thank you. I don't plan to use that kind of defense. I shouldn't have been driving and hadn't been. It was very unusual circumastances having to do with my wife. I tried to get a cab and couldn't. Bus service out here and where I had to go is non-exsistant. Unfortunately, I couldn't get hold of any friends at the time.

    I could have been on a number of "public" programs already and have managed to avoid that. I would sure hate to be in a medical wing at everyones expense.

    This shouldn't be nearly as bad (and maybe isn't) as it looks at this point. I had a cop who blew this way out of proportion. It probably would have been different if I had experience and knew what I was supposed to say. He is an angry young man. Thanks again

    You didn't have a license because you are a danger to yourself and others when you drive and then compounded the issue by giving a false name to the police and HE blew this out of proportion?

    None of your excuses mean anything. You are either legally allowed to drive or you are not.

    You are not.

    You decided to drive anyway.

    Dear Cyjeff and any others,
    I have aleady admitted what I did, particularly in terms of giving a false id, was incredibly stupid. I have no explanation for it. I was very rattled and scared of being sent to jail and acted very irrationally. I say it was blown out of proportion because it was obvious that I was rattled and a terrible liar. I fessed up very quickly. What I'm being charged with is the max with no empathy whatsoever. They can do that and so be it, but I'm hardly the kind that this punishment potential would produce any value for.

    As far as driving - in the states eyes and the Dr's eyes, I represent NO risk and could have easily obtained my license years ago. BUT, if you read what happened to me years ago and the fact that they never did find out what caused my seizures so many years ago, then perhaps you'll gain some insight as to why I don't want to. Again I say it's not my habit to drive. It was for my wife and I couldn't get a cab or bus and no friends were available at the time.

    Lastly - 2 points
    1 - I recognize that what's going on here is not what this forum is designed for and I will post nothing in public regarding this again.
    2- Are we a police state? Even according to the police report, I was doing nothing wrong and obeying all traffic laws. There was nothing suspicious about me or my (nice) car. He ran a random license plate check and saw that I had an ID, but no license and pulled me over.

    You're correct that the finger-pointing stuff is not what this forum is designed for.

    There is no constitutional issue raised by having the police run your plate. Whether the information they obtain (e.g., "the registered owner is not licensed") is enough to justify a traffic stop will depend upon the circumstances. If you match the description of the registered owner, or the officer pulls up a picture of you on his computer and can see that you're driving, that's likely going to be found sufficient to justify a traffic stop. If the registered owner is a 60-year-old, 300 pound male, and the driver can be observed to be a 20-year-old, 120 pound female, probably not.
