    Default Michigan HYTA Law

    i recently pled guilty for retail fraud and was given hyta. i am trying to enlist in the service (national guard) should i put on there that i was convicted or just put no. will they ever find out if i am now on probation

    Default HYTA Sentencing

    If you were sentenced under Michigan's Holmes Youthful Trainee Act, you were arrested, charged, and entered a guilty plea, but if you successfully complete your probation you are not convicted - that is, upon successful completion of HYTA probation no conviction is entered in your record. You should assume that they will learn of your arrest, so it is probably best to explain things up front.

    even if i started probation yet. i have 8 months of probation. will it count against me if i dont put yes. on of the question asked if i had ever been convicted. i thought under the hyta you shouldnt tell that you were unless it was revoked from you.

    Default HYTA Probation

    For HYTA probation, your conviction is not entered unless you violate the terms of your probation. So unless and until that happens, you're not convicted.

    i recently was convicted for retail fraud pled guilty and was given hyta. i am trying to enlist in the national guard. if they ask if i was ever convicted should i put no because it's under hyta. i havent started probation yet cause i was just sentenced (12-1-05).

    Default Convictions

    If all they ask about is convictions, you can truthfully answer that you have not been convicted. But this is a tricky type of thing to explain to somebody who doesn't understand HYTA, and finds out that you were arrested and entered a guilty plea.

    if they ask ("if i have ever been charged with a crime? have you ever been charged with or convicted of any offences? have i ever been in police involvement, including juvenille and minor traffic") under hyta can i put no for all of the question. since it will be keep off my file.
