    Default An Expungement or Sealing is B.S.

    All states---if you seal or expunge your record that is only half the battle. I am in the process of expunging a dismissed DUI BUT that will only get it out of the state database and allow me to deny it which may be fruitless.

    Why? You need to also check on all these data collecting websites and after the expungement make sure ALL of them remove your details as an opt out. If they scour the system again they will not find the expunged/sealed charge but until then they will have it on file and a background check by employer, rental agent etc. may well result in them knowing anyway!

    So after anything is expunged go to Axciom, which supplies the most personal data, and do searches on all others (Axciom even supplies Intellius which is the largest database for personal use) So you will have to opt out of all you can find until time enough has gone that if they do pick you up it is no longer in the system.

    Some states require private companies to clear their databases of information about sealed or expunged records, but from what I've seen most do not. So you're correct, a background check can still turn up a record even after it is sealed or expunged in the official state system.

    Not to mention that you have no legal recourse or way to remove, delete, or otherwise cause reporting of an arrest to disappear (i.e. weekly police bulletins that list arrests and are made public, jail websites that feature your image and charges and can be saved or archived by anyone, newspaper accounts of an incident that will be forever searchable online, and on and on and on). Expungement can only ever hide a charge from an officially dispursed record - but it'll always still be "out there" in other ways for the general public to find, and never disappears from law enforcement or court access.

    kind of sounds like spam to me.
