    Default Not Completeing a Drug Test

    My question involves criminal law for the state of: California

    I am currently on Probation for 2 more years. My po's have changed several times in the first year and i guess my last one didn't get my completion of community service recorded or whatever she did.

    This led to a random check of my house. Two probation officers came to my(none were my po) and went through my home and told me that my house was a mess and i have to go to the office to do a drug test.

    Never having done any sort of illegal drugs i was miffed only to the fact that i would be late for work that day, so i biked down to the pos office drinking lots of water. When i arrived my po told me my house was a mess and the normal im right your wrong chit chat. She told me i had to do a drug test, then took me on a search for a male officer. I thought this was strange, anyways we did the paper work then i asked should i empty my pockets or anything he said if you want you dont have to.

    I then was taken into the restroom and got a chill up my spine, i have had an inability to urine in a public restroom since i was a child, no clue why but its been like that forever, i couldn't even go in front of my wife for several years.
    and now i had to go in front of a complete stranger staring at me from a mirror on the ceiling. I could not go. he said that its no problem and we went outside.

    My po gave me a raised eyebrow and asked if i couldn't go because it was dirty, and i said no. She said they were going to lunch and she would not be back for 2 hours. I waited in the lobby for an hour and a half, all the while drinking water. And I had to go bad, thinking if i have to go that bad no matter who was watching i could still go

    2nd test was no better, this time she choose one the the 300 pound gangster looking officers. Did not happen, i came out again and she said that not being able to go counts as a failure and that i needed to come back on the 10th to be sent to jail on probation violation. I said i can take a blood test no problem, and she replied with an indignant, i don't stick needles in people, we dont do that.

    So with all that embarrassing info being said, What other options do i have for drug testing? How can she prove that ive done something illegal if i just cant go? What if i had an enlarged prostate or a physical condition that keeped me for urinating on command? Would the same apply?

    I have a hard time peeing on command, too, so you have my sympathies.

    Has this been documented by your physician? It's called paruresis and is a genuine medical condition.

    Get it documented and consult an attorney. I can't find anything that discusses whether or not paruresis counts as a violation, so you really want an attorney at your side!
