My question involves a careless driving ticket from the State of: Colorado
I was issue a careless driving ticket after being pulled over, but am not sure if I even committed careless driving. I was sitting at a red light waiting for the light to cycle. A green arrow appeared for a left turn, but was not followed by a green light to go straight. After the green arrow turned red the intersection remained with all red lights for well over a minute. From that point I signaled and turned from the middle lane to take a right thinking the light was not working properly and was taking an alternate route. At this point a block down the road I was pulled over and issued a careless driving ticket. When I asked the cop what I done improperly, her reply was that I accelerated away from her vehicle and screeched my wheels, but nothing to do with my right turn at the light. I did not exceed the speed limit and do not believe that I even screeched my wheels.
I have looked up the law and am confused by it:
(1) Any person who drives any motor vehicle, bicycle, or motorized bicycle in a careless and imprudent manner, without due regard for the width, grade, curves, corners, traffic, and use of the streets and highways and all other attendant circumstances, is guilty of careless driving. A person convicted of careless driving of a bicycle or motorized bicycle shall not be subject to the provisions of section 42-2-127
(2) Any person who violates any provision of this section commits a class 2 misdemeanor traffic offense, but, if the person's actions are the proximate cause of bodily injury or death to another, such person commits a class 1 misdemeanor traffic offense.
I was aware of my surroundings, knowing there was no other traffic on the road except a car behind me (which happened to be the cop), signaled and turned right staying within all lanes. Is this a ticket that I will have a good shot fighting in court?
