    Default Changing a Birth Certificate and Name

    My question involves paternity law for the State of: Kansas

    Issue;
    - had a non-legal documented paternity test done on my daughter, her father is not who I thought/who is on the birthcertificate
    - even though he is not her father, because his name is on the birth certificate does he have the right to say I can't leave the state with her?
    - If he has rights then how do I go about getting him off and the true father on? The paternity test proved who the father was, but like isaid it wasn't la legal document...if i get it legal can I easily change the birth certificate or will I need a lawyer....I don't have money to spare for something like this.

    Please help

    Not enough information...

    Were you married to him?
    If not, did he sign the Acknowledgement of Paternity form?

    We are not married.
    He did not sign an acknowledgement of paternity, he says the paternity test done is wrong - it is not a legal document, but it says my ex is the father.

    How was the father legally adjudicated to be the father? Was there a CS hearing and he waived the DNA test? How old is the child? Does the child and her/his father have a relationship? Is there a custody order?

    The DNA test will not be admissible in court.

    Man A is on the birth certificate but is not the father, threatening to take action if I take my daughter out of state - does he have that right since his name is on the birth certificate and it is a legal document?

    Man B was tested and found to be the father.

    How do I get Man A off the birth certificate and Man B on? Easiest/cheapest way...

    No custody order.

    My daughter is 2.5 years old.

    She and her biological father do not have relationship, but that is why I was leaving state for a weekend to see him. We only recently had the DNA test done, and got the results about a month ago. Her bioligical father wants to be a part of her life.

    Please answer ALL the questions I asked. Right now the father is the man on the BC...So any questions I ask relating to the FATHER I am referring to the man on the BC....And until paternity is disestablished (if at all possible) the FATHER can fight the move.

    Okay.
    We have done nothing with the courts.
    There was no custody hearing, I do not get child support, no DNA test was ordered. The three involved chose to go and get one.
    I am still living with the man on the birth certificate - he has daily contact with my daughter. He has a relationship with her.
    We believed he was the father, he was at the hospital, signed the birth certificate.
