My question involves an injury that occurred in the state of: WI
Actually, there hasn't been injury that's occured, but I'm being held liable in case there is one.
There is a concrete walkway between the neighbor's house and my own. The houses are only about 6 feet apart. Water running off my neighbor's backyard has eroded the soil beneath a portion of the concrete and left a big hole under it. The concrete also deteriorated to the point that the neighbor's kid and friends were jumping and stomping on it until it broke through, leaving a 3 foot diameter hole there---on their side of the property line. However, the erosion under the concrete extends all the way up to my house foundation, which means that when work is done to fill the hole and redo the concrete, mine will have to be done as well.
Now, who is liable for paying for all this? I am willing to pay for my side, which is 34 square feet. My neighbor's side is a 76 square foot area. My neighbor expects me to pay half the cost, and I said I'd pay a third of it. He is quite insistant that I pay half. He is a landlord, so it's possible he knows something I don't. I own my house, but he treats me like I'm his tenant in this matter!
The health dept. has ordered repairs done by july 1st, or we face fines of $198/daily
