    Default Custody After Child Turns 18

    My question involves emancipation laws for the State of: Indiana

    My son is 18 and his mother has custody. He will be a senior in high school in August and he would like to start living with me. His mom will not allow him to move. Since he is 18, can she stop him from moving in with me? Since he is still in high school would this need to go in front of a judge for a decision?

    No, you would not. The child has reached the age of majority, and no matter if he is still in high school or not, he is considered to be an adult. He may move without his mothers prior knowledge or consent.

    Thanks! Since he still has a year of High School, do I need to make any legal changes with the court other than support? I will not be asking her to pay but will stop my support payments.
