I live in New York, the Hudson Valley. Any feedback would be appreciated.
When we bought our house seven years ago, we were not aware that the only driveway for our house was not included in our property. Since we were first time home buyers, we neglected to ask our attorney to send us a copy of our survey showing our property lines, we didn't think the driveway wouldn't be included because there is no other place to park a car.
We ended up adding an easement to our deed at closing granting us "right of way" ... it allows us to use the driveway to gain access to our property. The same party that sold us our house is now selling the land that includes the driveway. I am hoping the people who buy this parcel of land are nice and understanding and allow us to keep parking there because we simply cannot afford to put a driveway on our property. We feel doubly burned because the person who sold us our house, also sub-divided these parcels HIMSELF! Someone actually approved his request and did a very poor job with the property lines.
Onto my question... is there any possible way I can "save" the driveway so we can continue to use it if the property is sold? We cannot afford the property for sale, we've offered to purchase a portion of the driveway but the seller said no. Is there any legal action we can take? And if the property is sold (there have been many offers that fell through) what suggestions do you have for negotiating with the new owners?
