    Question Vandalism Damage to Tires

    My question involves criminal law for the state of: Ohio

    I was accused of cutting the tires of a persons truck in Ohio. I was with other people at the time, so feel confident I will not be charged.

    I would like to know what a person could be charged with under Ohio Criminal Laws for cutting the tires on a vehicle.

    Please advise.

    Do I read this correctly?

    If the vehicle is a personal car, then vandalism does not apply?


    2909.05 Vandalism.

    (B)(1) No person shall knowingly cause physical harm to property that is owned or possessed by another, when either of the following applies:

    (a) The property is used by its owner or possessor in the owner’s or possessor’s profession, business, trade, or occupation, and the value of the property or the amount of physical harm involved is five hundred dollars or more;

    (b) Regardless of the value of the property or the amount of damage done, the property or its equivalent is necessary in order for its owner or possessor to engage in the owner’s or possessor’s profession, business, trade, or occupation.

    You read it incorrectly.

    I see only that the person has to prove that they drive the car to work and it is part of their occupation.

    And the number of people that participate in a crime does not necessarily lessen the charges against any of the group.

    All can be charged with the same crime if they all worked together to accomplish it. Google "Accessory"
