    Post Open Container Not Filed

    My question involves criminal law for the state of: Oregon

    Hi, I got an open container citation in public (I'm 21). I was about to throw away a nearly empty beer bottle when an officer stopped me and wrote me a citation. I went to court but the judge said the officer didn't follow through or process the ticket. He said I was free to go but the citation could still be processed. I asked if there was a certain time period when processing the citation would expire. He didn't not give me an answer so I am curious to know if anyone knows Oregon law to how long the officer has to process the open container citation until it expires. If I do get processed, what steps should I take to give me the best options? This is my first offense with the law ever. Is there diversion? Should I ask for stay of judification if it is possible? Any help would be great.

    I haven't been able to find anything discussing the timelines for citations to be considered processed in a timely manner.

    Should the ticket be processed, you'll need to go to court again. There's no such thing as diversion for an open container violation.

    I would advise consulting with an attorney, who may be able to get the charge dropped or the fine reduced on the basis of you having already appeared once.
