    Default What Do I Tell My Employer?

    My question involves criminal records for the state of: California

    At age 12 did some vandelism at school and got arrested. Was released to my parents. Never went to court, but got a letter to go see a probation officer, who made me do some community service. No legal problems since. During my 3rd year in college I applied to expunge my records. Got lawer, paid him 1800 bucks, and he set a court date. Never went to court...he called me and said the records were sealed, and sent me the paperwork from the court. Lawyer told me I never have to mention this on any job application, or on any application for medical school. Got into medical school, and never mentioned this to anyone....except for when I applied for a CA medical license. Got the medical liscence without a problem.

    Now I am finishing my medical residency, and applying for a job. They are doing a backround check, and are asking me to identify any criminal record....even if they were expunged. Should I mention this? Can they every use this for grounds to fire me, or not hire me if they somehow get access to my records?

    This is the first time I was asked to include such info, even if the records were expunged.

    Exact question:

    "Have you, as a juvenile or adult ever been convicted, fined, impisoned, or placed on probation or suspended sentence, or have you forfeited bail in connection with any offense in any civil or military court of law? Include convictions dismissed under penal code 1203.4. "

    You have to tell the truth, but I really doubt that they'll reject you based on something you did as a 12 year old. You're probably 28 by now and have a medical degree.

    You do need to tell the truth. If you lie & they find out, that will cause you more problems than if you told the truth about something you did at age 12.
