    Default Is this child support fraud

    My ex-wife has custody of my daughter, she can't handle her and refuses to sign her over to me leagally so therefore I still get her on my every other weekend basis. The thing is since she says she cant handle her she makes her go live with her uncle during the week and that way she only has to deal with her on the weekends that I dont have her. I still have to faithfully pay my child support but she only has her 2 weekends a month just like myself and the rest of the time she stays with her uncle. Is this child support fraud and if so what can i do?

    No, it is not child support fraud. If you don't like the present arrangement, and I can certainly see why you wouldn't, consult a lawyer about petitioning the court for a change of custody.

    I understand what you are saying, so therefore here is another question. If my daughter is staying with her uncle and my ex wife is not paying him anything but maybe a carton of cigs every now and then and she is keeping all the money wouldn't that be fraud?

    How would it be fraud? The fact that you don't like her child care arrangements and think she's getting a windfall doesn't make it fraud.

    It may not be fraud, but it may be in violation of the court decree. In my decree, it states that the minor child must remain in the residence his mother lives in. Check your paperwork, or give the Friend of the Court (or equivalent) a call.

    Default child support

    If I were you I will file a motion for visitation and complain to the judge that your daughter is not residing with her mom on her custody but you need proof that she is living with her uncle. You could ask your daughter to write a letter to the judge that she is staying with her uncle and she wants to stay with you.
    We almost have the same situation:
    My stepdaughter is always having a problem with her mom. She run away from home and brought her boyfriend at her room. Her mother is married having a child with her husband and she have a boyfriend who she goes to after work. My step daughter could see what her mom is doing. It is not really good at 14 years old to see this situation. She want to stay with us and we told her to write a letter to the judge and explain why she wants to stay with us.
    The judge decided to let my step daughter to stay with us. We got the custody on weekdays and she stay with her mom every weekend.
