    Default Theft By Deception

    My question involves criminal law for the state of: Illinois

    I purchased a boat in Illinois for $10,500 from a private party, I live in KY. At this time of the sale I was given a bill of sale and what appeared to be a title. Well it wasn't a title but a certificate of origin. The state of Kentucky is not recognizing that document for me to be able to title the boat. I have contacted the sellers and they keep telling me that they have looked into this and every thing they gave me is good enough. What can I do legally to get them to get a proper title to me?

    A "certificate of origin" is the original title. When a boat or car is produced the manufacturer issues a CERTIFICATE OF ORIGIN. This just means that your boat is NEW and you will be the first to title it.

    Whomever told you that the certificate of origin is NOT a title is 10000% wrong. Contact motor vehicles in KY and straighten this out. Every new car, boat, motorcycle has such a certificate issued. The dealer brings the certificate to motor vehicles and it is titled to the new owner as a new vehicle.

    I forgot to mention it was a used boat. I bought it from the original owner, they never had it registered for the 2 years they had it.

    If the VIN # on the boat matches the VIN number on the "certificate of origin" then you are all set.

    Just because the original owner never bothered to re title the boat they can still transfer the COFA to you.

    The CofA is ownership and the same as a title (it is the title).

    Just be sure the hull numbers on the boat are the same as on the CofA, if they are you are all set.

    The state of KY and the state of IL both tell me that a COO is non-transferrable. It the way for a new boat to apply for a state title. I have tried several times and KY won't process.

    You would need a bill of sale from the previous owner and the certificate. You must have a bill of sale as well

    The certificate can be transfered with a bill of sale.

    You can also contact the manuf of the boat, fax them the present Cert, and see if they will issue you a new one to your name if all else fails.
