    Default Subtenant Padlocked Room And Kept Keys After Voluntary Move-Out

    My question involves landlord-tenant law in the State of: New York.

    (Non-rent regulated apartment)
    My sublet left under bad terms. He did not surrender the keys and left a pad lock on the bedroom door (he took all of his belongings). Can I remove the bedroom lock? Do I have the authority to have access to all areas of my apartment? It is the only bedroom with windows - could I tell him its against NYC fire code. Also, do I risk "early lockout" if I change the front door locks? This guy is a nut job and I don't want him near me, my other roommate, or our apartment.

    He signed a contract with me to rent the room April 1st though July 31st. On May 31st, he canceled his postdated checks (which were part of our agreement) and demanded that I use his deposit $ to pay his share of June rent, which I reluctantly allowed him to do, terminating his contract on June 30th. He then informed me that he would be "moving out" and "vacating" June 15th - several times in writing (email).

    Yes, he did. And updated news now... turns out he hid the keys in a flower pot! I opened the room (by prying the latch free from the door frame) and have begun preparing it for the next sublet. I assume this mess is over with, but just to be on the safe side... Anyway, he could have 1.)made dups of the keys, and legally come back, then 2.) sue (?) me for tampering with his lock even though he left?

    If you're worried that he made copies, talk to your landlord about getting the apartment rekeyed.

    As for what he'll do about the lock? You would have to ask him.
