    Post CPS Took My Son And Didn't Notify Me

    My question involves a child custody in the state of ky/ oh

    cps came in and took my x's kids away from her. one of them was my 3 year old son. they never even contacted me just gave the kids to her stepmom and set a court date. her step mom called me today and told me what was going on. she said myt x told cps that i was on drugs and that she has no way to contact me. that is a lie! then her step mom tells me that they are going to start random drug testing all of us involved ( that doesnt bother me because i dont use drugs) and they said based on what they were told that i have no chance in getting custody of my own son. i need some advice asap. please help

    Don't rely on third party messages - you need to be hearing whatever is relevent from CPS directly. Your x already lied about knowing your whereabouts, and you don't know for a fact that stepmom is giving you complete or accurate info either. Individuals and families are notorious for working their own agendas in custody battles - so just be aware of the dynamic.

    Was the x an ex-girlfriend, or an ex-wife?
    Has paternity been established?
    What is the current standing of visitation/custody according to the court?

    she was an x gf , we were never married and we have had a paternity test and i have been paying support for the last 3 years, never mised a payment.

    Do you have a lawyer representing your interests yet? If not, I urge you to get a lawyer.

    You need an attorney yesterday. As long as paternity has been established and you can show that you are fit and willing parent, you stand a very good chance at obtaining custody.

    Stay in contact with your x's SM so that you can keep the connection with your son, but ignore what she tells you and follow ONLY the advice of your attorney.

    after looking into an attorney i noticed that i cant afford one. the cheapest one wants a 5000 dollar retainer to even touch the case. i guess i am going to have to try to do it without one and i have no idea where to even get the forms to file. my son lives in Independence KY and the court doesnt offer a do it yourself packet like the cincinnati juvenile court does. also i was told there is a court date july 7 and i stll dont know why i wasnt notified about that one either.

    one place when dealing with cps that you have to look for rules and such is www.childwelfare.gov there are links to each state on there.

    Now I don't know if this will work where you are but a friend of mine had her kids taken by cps. The next day her brother went to family court and filed a petition for emergency custody got a hearing and he had the child 3 days later. She told me that if you are a blood relative and can prove it and have no criminal back round or anything the judge likes to keep the kids with bio family. Since you are the bio father and can prove it you should be able to file for custody in the family court and get it. All I know for sure is the brother does have the child in my friends case cause her son called my son from there for the past few days.
