    Default Seventeen-Year-Old Charged With Identity Theft And Petit Larceny

    My question involves criminal law for the state of: New York

    Son is 17 and has 2 counts charged for identity theft and petite larceny for amount of ~ $ 800.

    I have hired a criminal defense lawyer. To date, we have been to arringement and a court date. His case is not yet assigned to a PP.

    1. Need advise on what he can plea bargain for.
    2. He is an LPR. Can he travel outside of US with these pending charges? We need to go home for a month. Haven't been outside the country in 8 years.

    Please advise. We are devastated that this happened. We cannot erase what has been done but I need help to give him a second chance to recapture his future.

    Just incase down the line your attorney feels that it is in your best interest for your son to plead guilty BE SURE to ask for YO status (youthful offender) in NY. NY law allows for this if your child was UNDER 18 at the time of the crime.

    That will seal his record and he can lead a normal life. I hope this all works out for you, good luck

    Thank you OhMy! for responding so promptly. My attorney is going to try for YO status. The complaint is filed in NY but we live in NJ. We have been going to NY for the arraigment and court date.

    Even if a YO status is given, should we still try to reduce the charges that we are pleading guilty to?

    If we move on from this incident, will this come back and haunt us again from unauthorized credit card charges from another state?

    Do you know if he can travel out of US with pending case? We have a green card.

    My dad is not doing very well and after 8 long years, we are finally going home. I have not told my family about this because all they will do is ruin his sprits for the rest of his life.

    YO status in NY will not reduce the charges but I am sure your lawyer will try to plea bargain this down to a lesser charge. YO will just bury the case for your son in the future, and no one will be able to see the conviction if he goes for a guilty plea.

    If your son pleads guilty I am sure that your lawyer will have the DA stipulate all KNOWN AND UNKNOWN charges, meaning if anything new pops up they cant bring more charges against him. Providing it is related to this case. Such as another credit card fraud surface from the same period of time as the others came about.

    As far as your son being able to travel.... He needs court approval to leave the state of NJ and NY to go to another state. He would need court approval to leave the USA as well, I doubt the court would grant him permission to leave the USA until the case is fully resolved.

    Default Need advise...

    My attorney is working on a plea bargain. Need some advise. My son has been admitted to Univ in Illinois. Since he may be convicted with Youthful offender status, do we need to inform the university of the conviction?

    All this happened after he got admitted.
