    Default Back Child Support While On Probation

    My question involves child support in the State of: Florida

    My question is this: My husband was incarcerated in November 2007. He has spent the last 4 months in a court ordered rehab the last 4 months following his incarceration. 2 questions:
    1. Does child support still accumulate during incarceration in Florida or is it put on hold?

    2. Once he is out in 2 months, can they issue a warrant for his arrest for this back child support AND will this civil case cause a violation of his state probation because he came in contact with the police. In other words, can a civil arrest cause a violation of him criminal case?

    Arrears accrue until a Judge rules otherwise.

    Yes, they can issue a warrant for his arrest. However, first they will file a motion for contempt. If he does not appear for the hearing, a warrant will be issued.

    Yes, it's extremely possible that he would be charged with a VOP if he is arrested for ANY reason.

    The best thing he can do is the day he gets out he needs to talk to the DOR CSE and make arrangements to begin paying on-going support and the arrears. If he does this, he won't have to worry about a contempt charge, arrest or a VOP for the arrest.
