    Default Is Signed Offer Letter Binding For Company

    I signed an offer letter staing my start date as Monday 5/26. Based on that information, I gave my 2 week notice at my current position to end the Friday 5/23. During the next 2 weeks my new company sent an email telling me to start on 5/27 since Monday was a holiday. I assumed that since the offer letter states that I am employed as of 5/26, I am entitled to getting payed for the holiday since I am a full-time employee. This is in Texas.

    The employer did not pay me for that day. Can they change my start date when I have a signed offer letter?

    Do I have any legal recourse?

    I lost a potentianl days wage from my first company by their change?

    Offer letters "usually" are not binding though there are occasions when they might be. They are normally not considered an employment contract. (Don't rise to the level of a contract.) You would have to take it to an employment or contract attorney in your area for review. However, for one day's pay I don't see where it would be worth it. I don't know if you are an exempt or non-exempt employee but some companies don't even pay for holidays - they don't have to unless it's in an employment contract or CBA.

    Thanks for the info. I am entitled to paid holdays and the letter states as of 5/26 I am considered a full-time employee and entitled to the benifts thereof.

    I think the wording of the offer letter backs my case. But I have made by case and they disagree. So for just one day I guess I will have to live with it. But it does not make a good first impression of this company during my first couple of weeks of work.

    As I indicated previously, offer letters *normally* do not rise to the level of a contract & you might not want to make waves just starting with a new employer.
