    Default Interstate custody

    I have been separated from my wife now for over 3 years and in the last almost 2 years she hasnt allowed me to talk to our children on the phone even! All we have in place is child support in FL. I want to know if I can file for divorce and custody arrangement in ME? Also can I pick them up in Fl and bring them to ME for vacation? One is in school, the other isnt old enough yet. During that time could I file for temp. custody, or would that look bad on my behalf? I mean she has kept them from me for pretty much 3 years. Never home when I would go see them. We were married in Maine and the first child was born here. I have been in ME for more than 6 months. If anyone knows a great lawyer in either state please post the info. Or any specific state laws.

    Default Divorce Jurisdiction

    If the children have been domiciled in Florida for more than six months, it is unlikely that you will be able to litigate custody in Maine - that is, Florida would be the children's home state.
