    Post Friends Lied And Sued My Insurance

    My question involves defamation in the state of: Seeing what could be done with the situation at hand as explained below.

    About four months ago my friend kept bugging me to let him drive my car (Ford Focus 04). It was a stupid of me to let him drive but I did and the damage is done.

    We was going down the road(two lanes) and a 18-Wheeler hit us on our side of the road. Everyone else got out of the car and went to the hospital besides me. I stayed behind to talk to the police.

    I told the police that my friend was driving the vehicle; not to mention there was two eye witnesses that seen him driving.

    So we all get home and me and my girlfriend start working on the insurance. We call my friend and his girlfriend which was also riding in the vehicle, and they start asking me to say that I was driving the car. I was not about to lie to anyone about driving that car. There was no point in it. If my friend had some problems with the cops and his license, then that was himself and had nothing to do with me, or my property.

    The next thing I know is that both him and his girlfriend has gotten a lawyer and was telling this lawyer that I was driving the car. My girlfriend called the lawyer and tried to explain, but it seems as if the guy was just persistent.

    It turns out that both him and his girlfriend sued my car insurance and collected a lump sum of money. I quit talking to them after they got the lawyer because I knew deep down they was just trying to get some money out of the situation.

    So now the guy is telling people how he "swindled us" and I could line up the witnesses that has heard him say this. His girlfriend is in a rehab, but I imagine she got there with my insurance company and is saying the same thing from time to time.

    I feel as if the police and the insurance did not investigate the accident clearly. Not to mention that now I am sitting around the house with no public transport, no job, and now taking prescription medicine for my depression.

    I am totally ignorant on how the law works and I'm not sure if I can do anything about it. The wreck happened around four months ago and at the time no one was offering me advice. Just telling me what I did wrong.

    You did not mention the state where this happened.

    I also do not see a question.

    What exactly do you want to do?

    Sue your ex friend because he is telling people he swindled you?

    Sorry my mistake. I had it planned to add that information to the bottom but I must have forgotten it.

    I don't really know what questions I could ask; as I said before I'm totally ignorant on law. I want to get my life back and that would include a car.

    Your insurance company should be handling this for you.

    Why haven't they compensated you for the loss of your vehicle?

    You did call your ins. co. yourself didn't you to report the accident, give your side of the story & report the damage to your car? What is your ins. co./ins. agt. telling you about replacement of your vehicle?

    I didn't really have the (excuse the broad term) balls to ask him Betty3. I was hinting around about it but he kept asking questions like "do you have anymore proof that your friend was driving the car". The witnesses wasn't really valid at the end of the day.

    Someone told me where my two passengers had a different story that they couldn't hold it up in court? I'm guessing that is why.

    My friends blood was all over the air bag in the driver side because of him not wearing a belt. I clearly had no injuries and didn't go to the hospital. (I was walking around sitting in cop cruisers and consulting family of the accident)

    I told my insurance agent that and he brushed it off as if I was insane. I guess insurance doesn't do the DNA things?

    I need to do something now. I know there is something around that I could use to my advantage to get me my vehicle back. These guys are running around telling everyone how they swindled us, even telling people how he was driving the car and had it turned that I was. Couldn't I record them saying that?

    I brushed this whole thing off before, but now I'm just starting to go into a deep depression. I have tried and have failed to obtain another car. There is no public transport out here so I can't get a job. I can't even go back to Chicago :/

    I have exactly 500 dollars that I have been saving (thank god for the government check that came through recently) but it's not really enough to get a car as I have tried for 2 months now.
