I agree with sticking to questions that relate to the facts of the case. What part of the EEOC process are you in? Is it the initial mediation (before an investigation by the EEOC) or conciliation (after the investigation)? Have both sides agreed to try mediation? Neither side is required to do so.

EEOC mediation is not designed to discuss the facts of your case. It's designed to allow the parties to discuss how to resolve the complaint. Nonetheless, if you've got questions about what is allowed during the mediation session, you need to ask the EEOC staffer who is handling your mediation.
