My question involves criminal law for the state of: Georgia. Last night we received a call from my daughter. She's hysterical and crying that "He won't give me my baby!" "He called the cops and they are going to take me to jail!" We had no idea what was going on but we rushed to their home. Background: She had a baby 3 weeks ago C-section and lives with the father who is still legally married but has been fighting for a divorce and custudy with his current wife who is living in Florida with their 2 children. Situation--My daughter and boyfriend had been having words for several hours when she told him she was taking the baby and leaving him. He took the baby, locked himself in the bedroom and told her he wasn't losing another one of his children to the mother. She got hysterical because he wouldn't let her have the baby. She broke the bedroom door down with a knife in her hand. He called the police while she sat on the floor crying. The police came. They took her to jail. The officer told me she may or may not get bond this morning when it goes to the magistrate. I don't even know where to start in trying to get her whatever help she needs and I don't have any idea who to call to get information on what is going to happen with her. I found the charges on the county jail website as "Criminal Trespass" "Obstruction 911" and "Aggravated Assault". Would she even get bail in a situation like this? Would the judge take into consideration the fact she just had surgery and has a new baby? I just don't know what to expect. Any help of any kind would be appreciated. I have never had to deal with the legal system before. Note: She has never been in trouble or caused any legal trouble before this episode last night. Please assist me with information of any kind. I'm desperate to know where to turn. Thanks.
