    Default Roommate Refuses Every Potential New Roommate

    I signed a lease to live in a two bedroom with my friend. Before we moved in, we had a large falling out. I do not want to live there (never really did). So I have talked to both the leasing office and her and I can transfer my half of the lease for $150. BUT I need my ‘friend’ to approve this roommate, according to the leasing office. My roommate is denying every single person I find and bring over.

    I realized that she knows I am not going to skip out on the rent because I don’t want an eviction on my record, and she is enjoying living alone, and upset with me. She can deny and deny until I have to pay for half of this place for one year, and that is exactly what she’s has doing. It’s already cost me over $700 and I’m not even living there, paying rent in two places now.

    What can I do? I have absolutely NO leverage, she’s in completely control and the leasing office is not helping at all. Please, I’m desperate to know if I have any legal rights here.

    Is this for real? Can she really ride me out until the end of our lease like this?

    You can sue her in small claims court and try to make the case that she has been unreasonable in turning down roommates, justifying her having to reimburse you for your half o the rent. I don't promise you what the court will do. As you were told when you posted, laws are different in each state.

    Regardless of what the leasing office says, what you are bound by is the actual lease contract that you signed. Read it carefully and see exactly what it says about such transfers. It might even be worth it to take the lease to a local attorney and pay for a half an hour of time to see exactly what you agreed to, which might be significantly different than what you're being asked to do now.
