    Default When And How To Change My Last Name To My Mother's Maiden Last Name

    My question involves name change laws in the State of: Illinois, i am 17 and i am going to have a child right before i am 18, i want my last name changed before i have my baby so we can both have my mothers maiden name, so i do not have to go through all the hassle's after my child is born. I am starting college next fall and would like to have this all done before i start. I do know who the babies father is but we are not together and do not even talk, most likely he will be in jail again by the time i give birth , and if i have my name changed before the baby is born i can give my child my new last name , but i do not know what i have to do to change my last name, i think my mother would agree but not my dad. i don't really talk to him much he is always to busy for me, the bar and his new weekly girlfriends take all his time so it is hard to find him most of the time , and when and if i do his is usually drunk, so i wouldn't get to far with him. So can some one please help me and let me know what rights i have to change my last name at 17 with child in the state of Illinois?

    The Father can protest the child's name if he desires. Furthermore on your name change your Father may protest long as you are not yet 18

    The father of your child can only protest the name once paternity has been legally established, and even then, he isn't guaranteed to get his way.

    Your Mother is going to have to help you with your name change, she needs to file on your behalf.

    For clarification though- the OP's father will have to agree to the name change as long as she is under age 18.
