Hi,
I live in Oregon. Last May, I was charged with Class B Misdemeanor for domestic harrasement. I plead guilty as part of deferred sentencing program, charges will be dropped after completion of a domestic violence class.
I am almost done with my classes, and expect charges to be dropped within two months.
I received a noticed from USCIS last month indicating that my My I485 application was transfered to Nation Benifit Center awaiting standard interview.
I have four questions:
1- Why was my application transfered to NBC? Other friends' applications were approved immediately, could it be because of my criminal charges?
2- USCIS website didn't have processing times for I-485 at NBC, I am worried my application was sent there by mistake. Does NBC usually handle I485?
3- Do I need an attorny present with me during the interview? Or can I assume since my application finished the background checks without being rejected that the USCIS didn't care about the charges, and no need to get an attorny?
4- I am applying to I-485 through my employer's attorney. I would not want my employer to know of the criminal charges. Would I need to hire an outside attorny to be present during the interview?
