    Default Male Nurse Falsely Accused Of "Sexual Allegations" - Will A Polygraph Help Me?

    My question involves defamation in the state of: Illinois

    I’m in an unfortunate position of he-said-she-said in the nursing profession. If I say in my documentation that I am willing to pay to have a polygraph exam to add support to my written documentation, will this help add credibility to my documents?

    If I offer to pay for a polygraph exam for my accusers, will this help convince the reader of the case that I am telling the truth?


    Nursing is a very dangerous profession for a male to be in because 1.he is severely out-numbered and 2. When things go sour, the female nurse will grab her friend or two and railroad the male nurse by throwing the "sexual harassment" life preserver...........this is going to be a tuff life lesson. Please help........I change diapers, bath, feed, and care for the suffering.........I’m hoping Karma can swing in my direction and help a little during this bumpy road.

    I don't see how it could hurt, but it won't necessarily help.

    Who is reading the case?

    In your other post, http://www.expertlaw.com/forums/showthread.php?t=51297, you indicated that you only learned 15 months after you left, that your former employer had designated you as not eligible for rehire because of sexual allegations. You apparently learned about the designation during a background check done so you could obtain a commission in the Army. You said that the Army recruiter said that the comment wouldn't affect your getting the commission.

    How do you plan to get your accusers to take a polygraph test? To whom do you plan to give the polygraph test results? It would be easier if you took a polygraph test, but you would still have the problem of getting the results into your record at your former employer.

    As best I can determine, your actions and feelings are making "this road" bumpy.

    I learned of the designation myself when I called my old manager and asked him who I should put down as my supervisor on the Army application. I was trying to feel him out to see if he was still being abrasive. He then told me "I think youre going to have a problem because I think HR put you down as not-eligible for rehire but i dont remeber because it was so long ago".

    My accuser will probably not take a polygraph which will add support that they're lying. I will put the polygraph result in my employee file.

    Are you saying they can refuse to insert my polygraph results into my file?


    One other thing I havent mentioned and why Im making a big deal out of this, I applied with the FBI 2 years ago , they brought me along in the process and then dropped me and told me to reapply. Ive now enhanced my resume with a RN license and want to give it one last shot before the age deadline of 37...........with my RN license, Im thinking about DEA too.

    Please believe me here, who offers to give themselves a polygraph to prove theyre telling the truth............the ones telling the truth.

    Yes, your ex-employer can refuse to insert polygraph results or anything else into your personnel file and probably will. Besides, unless your ex-employer decides to change its designation that you are ineligible for rehire because of the sexual allegations, what else is in your file is irrelevant. Prospective employers don't ask for or receive an ex-employee's personnel file.

    You might want to read up on the Employee Polygraph Protection Act. There are only very specific circumstances where polygraphs can be used. Employers could actually get into legal trouble by requiring them.

    "The Employee Polygraph Protection Act of 1988 (EPPA) generally prevents employers from using lie detector tests, either for pre-employment screening or during the course of employment, with certain exemptions. Employers generally may not require or request any employee or job applicant to take a lie detector test, or discharge, discipline, or discriminate against an employee or job applicant for refusing to take a test or for exercising other rights under the Act. " from the DOL

    So when you state that the accuser would be looked at negatively for not being willing to take a polygraph, you are totally wrong in that -- they can not be based on the EPPA. And you are wrong in the fact that the former employer be required to put anything from you in your file. Personally, I don't think a polygraph would help your case at all.

    talked with HR and got a copy of my file - there is nothing in there, other then the usual forms when youre hired. No documents of allegations, no quotes from nurses, nothing.

    I dont know how to take this. Is there another file my ex-boss has in his drawer he will pull out and use if need be at a future date.

    Call an employment attorney and think about "you" taking the poly. If it comes out good, you can try to use it as leverage in the threat of a defamation suit. Then you can open lines of negotiations with your former employer - such as a correction of your file (for starters). The truth is always a defense against slander and defamation so if you have that on your side you could always post a blog about your accusers and what they did to you, so you can publicly expose the truth.
