    Question Contractor Wants To Pay To Tap Into My Sewer

    Hello - we are stumped! A contractor is building a subdivision directly next door to our property. There is NO sewer on his land. We, however, DO have a sewer on our property. As a matter of fact, he needs an 8 inch pipe, which is also what we have. He has offered us what we think is a small sum of money so he can tap into our sewer line. This will be for the entire subdivision of 27 duplex homes. What would be considered a fair amount to allow him to dig up halfway through our yard so 27 other homeowners can have sewer? We know that if we do not give him access, he will have to go all the way around our property, and down the road quite a way, and will end up paying ALOT more than he's offering us. We don't want to be greedy, just don't want to let someone walk all over us because he's got alot more $$$ in his pockets, and "knows" all the important people who work for the county we live in. We live in Delaware. Thanks!

    Interesting that the developer contacted you. You might tell them your not interested in having your yard all messed up for the summer and that the money was an insult. Next will be the county asking. You might figure out what it cost to go around and work from there. If there is a problem guess where it will be? Should they put a blow out there guess what ends up in your front yard? If you do allow this get an attorney do draw up the easement document. I would rather you get a license agreement and make them pay each year. Good luck

    Thank you landagent! We are already thinking along the same lines as you. We did make him a counter offer though - swap our house with one of the new ones he is building. This way it will be a win-win situation for everyone. Since we are not in a neighborhood, and live at the last house at the bottom of a hill, all the water run-off from the construction site will be coming into our side yard, & runoff from the main highway we live on comes into our front yard anyway. So, if the contractor REALLY wants the sewer, and doesn't want the hassle of going all the way around our property, he'll take US up on OUR offer....We've already written to our county officials, the transportation department about all the surrounding problems we are having with our property. The sewer easement is just a minute portion of a very complex pre-existing matter . Thank you again!

    Good luck with this. Seems like you have a lot of things going on with the sub division some of which may be actionable. You need a good real estate lawyer to make sure you don't end up screwed. One that knows his way around the county officals and the courthouse. Sounds like some enviromental issues are happening.
