My question involves child support in the State of: Florida
Difficult situation, I am a Permanent guardian under FS 39.6221. Both bio parents have CS orders. Bio Dad pays most of his to CSE, he has 1 contempt and a substantial arrearage, but makes some effort. Bio mom was ordered to pay about $300/ month in 9/2004. She had garnishee orders and such and her DL is suspended now for years. 1st contempt was in 2005, Second in late 2006 with a paid $1,000 purge (the first money ever paid), the third is going to court next week. At this point, the only money seen is the purge and two very small IRS intercepts (say $400.00+\-). Bio Mom has been gainfully employed the duration. What can I expect to see as the penalties imposed next week in court?
The money does not go to me, however, the Bio Mom is one who files motions (because it is free to her) and makes life miserable for we who take care of the child, and I want to see her vested in the process somehow, so it is not just a big game. So far, we have covered all of her (and Bio Dad's) costs of supervised visitations, transportation and mediation because otherwise, it would not happen. Then Bio Mom or Bio Dad will file a motion over nonsence, an impractical visit or unhappy about something, drag us into court (it's free for them to do so), force us to pay an attorney and waste the court's time, and then laugh about it (I guess they showed us, huh?) and this has been going on for years now. To give you an idea how rediculas, the child had surgery the day before a court ordered visit and they objected to our refusal to carry her to the next town as the court ordered time.
Keep in mind the DL thing means nothing to her (why do you need a license just to drive?) and her mode to avoid Garnishee seems to be multiple temp services working together to shield her (she has worked the same place for two years and when CSE finds her, she just quits the one agency and goes to the other, never missing even a day of work, well, at least she is working.....).
Just by rough calculation, the arrearage is in the $12k range.
And since I was noticed to attend, what can I tell the court to make it more likely she will become vested?
