    Post Criminal Sexual Conduct 3rd Degree

    My question involves criminal law for the state of: Mi

    This case is a bit difficult because when(keeping things sort) I was 13 I had messed with a guy who was 23. Later on got pregnant by him at the age of 14 and he was 24. I told him,he took off when I was 2 months along. Well, my parent's found out when I was 6 months along , they reported it to the police. The detective recorded me while she was asking questions. She put a warrant for his arrest because he had took off to Georgia where he is from he got in trouble down there and was in jail for 533 days. Then he got extradited back to Mi. This past Feb.. He had his preliminary exam and I had to testify his attorny of course brought up some juvenile case I had. Well, I'm 18 now and they took my son's Dna,mine,and ordered the father's Dna at the preliminary exam back in March. He had a jury trial today but it got engurned or post bonded because the Dna still hasn't came back. I recently found his family and contacted them and let them know that my son is here. I sent pictures and everything. Right now my son's father has a no contact with victim right now because he is on bail bond. Now my biggest question is by contacing his family can that affect the court case and when this is all done I want my son's father to be able to know my son and be in his life and I want to be able to write him after everything is done with and ask him questions and send him pictures of his son. But since he has no contact with victim right now does that mean it has to be like that if he get's locked up or after the case is done. What can I do about my son and his father being able to see each other??? Could I visit him if he does get locked up?? I mean this happend so long ago when I was a minor and now that I'm 18 shouldn't I have a say so?

    Once the trial is over, you can work on visiting dad.

    Your age now doesn't matter in his case at all.

    Well, I know that but I mean after everything is done with is he going to be able to be allowed to have contact with me??? Since I'am an adult now and not a minor.

    Are you saying that when he gets out of prison in 15 to 20 years can you date?

    NO lmao I don't want to be with him and he has a max of 15 yrs in prison he might not get that if he takes a plea deal after the dna is in. Their thinkin about 5 years. I mean am I going to be able to take my son to him and visit him. What about while he is locked up for it??? Are they going to take off the no contact with the victim off???

    That will be up to the judge... probably yes.

    However, do you really want to introduce your child to her father through wireglass?

    Well, I see it this way my son is now 3 yrs old I want him to be able to know who his father is because 5 yrs go by he will be 8 yrs old. I don't want his dad to be a stranger and when my son does get older I want his father to tell him he did wrong for messin with mommy. Wireglass is better than not seeing or knowing at all. I put myself in my son's shoe's alot of times.

    Just know that no matter how scary a prison is to an adult, multiply that by 100 for a child.

    You will also have to deal with the child's knowledge that he was a product of an illegal rape.

    I recommend, strongly, that you talk to a child psycologist about these visits before you go down that road.

    Okay, That will probably be a little while before he see's him, anyways. Since it's taking so long for the DNA to come back, by any chance can u give a estimate how long will it take for the dna to come back? They sent it to Lansing,MI. crime lab because their using it as evidence. They sent it back in March and it's takin so long. The detective said, "The prosecutor is tryin to put a rush on it". It was suppose to be here before the jury trial today. Won't I have a say so in the plea deal because the prosecutor said whatever makes me happy. I was thinkin 3-5 yrs for the time he missed out on responsibilitys. My father also told the prosecutor 5 yrs and also they usually send these dna things out to another state, but they kept in Michigan so it would be faster. What's the longest that it could take for this??? O yea, would I have to testify again if he doesn't take the plea deal and goes on with the jury trial, when the dna is here???

    It would really be helpful to the members of this forum if you were to use proper capitalization and punctuation. Standard spelling rather than slang or text would also be appreciated. Run on sentences are difficult to decipher.
