My question involves labor and employment law for the state of: Wisconsin

I have a Workman's comp. injury that my hours off due to my injury are applied to my FMLA hours. For the year 2007, my FMLA hours where used up with the time I had off for my surgery and recovery. I was suspended for three days and then two weeks for the time I missed due to my injury. They then decided I need a note from the Doctor every time I missed work. Which I did for the rest of 2007. They gave me a letter stating I only earned 10 days of FMLA leave for 2008. Which was used up in the begin of the year. Now, I am schedule to have surgery again and out of no where I earned 12-weeks of FMLA to cover my surgery time. How do they figure out your hours earned for FMLA? Are my hour's worked in 2007 for 2008?
