    Post Child Support

    My question involves child support in the State of: NY

    My husband and I separated and filed for divorce in 2005 and the divorce became final in January 2008. We have since patched our relationship back up and remarried. I was supposed to start receiving child support, but since we have remarried what would be the process for the child support not to be garnished from his pay check?

    Is the state CSE agency involved in your case? If they are, you can ask them to stop the garnishment.

    If CSE is not involved, you will need to file for a modification of the order. In the mean time, if the garnishments begin and you are living together it won't make much difference since the money will go right back into the same household.
