    Default Rental Car Liability - Loss Of Use Of My Vehicle

    My question involves insurance law for the state of: CA

    My parked car was t-boned by a runaway vehicle and that vehicles insurance (Mercury) has agreed to responsibility. I have been told that repairs will take roughly 6 weeks and cost in excess of $13000.

    My vehicle is considered luxury (7 Series BMW) and my question is in regard to the lack of a high end rental car and/or reimbursement for the loss of use of my vehicle. 6 weeks is quite a long time....

    In other words, can I seek additional damages for the loss of use of my vehicle even though they are providing me with a $38 a day rental.

    No but in most states (not sure about CA) you can get dimunition in value because of the wreck. Talk to the dealership and be carefull what you sign. Not sure what the limits are in
    CA on small claims but I picked up an extra 3,000 this way on a Mercedes. All they wanted to do was just repair the car.
