    Default Public Utility Company

    My question involves collection proceedings in the State of: Ohio

    I received a notice from a collection agency yesterday that is for a final utility bill from February 1997. This is the first notification I have had for this debt. I moved out of that town at the end of Feb. 1997 but always had a forwarding address with the local post office. Isn't the statute of limitations up for this collection? Also, if I do pay the bill, isn't it possible they could try to collect interest and penalties for the last 10 years? Thanks for your assistance.

    If you do pay the bill, make sure it's acknowledged as payment in full.

    I believe Ohio offers a fifteen year statute of limitations for most written contracts.

    Thanks for the response. I sent a letter yesterday to the collection agency to dispute the validity of the bill and ask for proof from the utility company. Since it is only $73, I will probably pay it. But how do I guarantee they will take it as "payment in full"? Also, if for some reason I decide NOT to pay it, can they actually post it negatively to my credit report (11 years later ?) Would the credit reporting bureau really post something that old? Thanks again.
