    Default Exclusives And Non Compete Clauses

    My question involves real estate located in the State of: NY

    I have a store in a shopping center that sells breakfast and lunch National Franchise.

    The land lord wants to open a store another national franchise that shares the same property as my shoping center but that land is under a separate corporation. this will probably cause my sales to drop 3000 a week if they open.

    The store will be opened 150 ft from my store.

    the property is a separate corporation so my exclusives and non- compete means nothing however its the same owners.

    do i have any ground to stand on for a lawsuit? separate corporations are established for both properties but the same owners (landlord) owns these properties.

    That's probably the beginning and end of it, right there. You need to consult a local lawyer to discuss your options.
