    Question How To Remove A Default Judgement From Your Credit

    My question involves collection proceedings in the State of: Florida

    I have a court date set for tomorrow that I cannot appear at (it is in Florida and I cannot take time off from my job). I know I am going to get a default judgement. I have tried to contact the attorney as I want to pay this off IN FULL before the court date, but he is not returning my calls. At this point I am thinking he would rather go to court so he can tack on added fees/court costs to the amount due. In any event, what happens after I get the default judgement? When I pay it off in full will it be removed from my credit report, or how do I go about removing it from my credit?

    I just want this nightmare to be over.

    Yes, they will get a default judgment against you if you do not show up in court.

    The attorney does not have to talk to you before the court date. (though some do)

    After they get the default judgment against you, if you don't pay the judgment, they can seize all non-exempt assets allowed in your state. If you pay it off, they won't seize any assets but a judgment will still remain on your credit report for 7 years. The only way you might possibly get the judgment removed, would be a "pay for delete" - you pay the creditor to remove it from your report. The creditor will file forms will the court to dismiss it. Many creditors will not do this though. If they would be willing, get all terms in writing.

    I might add that you can sometimes make a motion with the court to vacate a judgment if you believe you were sued in error for example.
