We purchased property one year ago which had encroachment on public land- big mistake .It has a shed, fence and apple tree on encroachment- 1990 survey map shows this encroachment. The town sent us a letter days ago saying they are building a berm/ dyke on alley so they need to widen the alley onto encroached land. This dyke will be 3 feet higher than now. We are worried about privacy issues. They also have given us 30 days to remove the property. Shed is used for storage and has a bed, sometimes we stay in it (summer) & has cement basement . We are checking into moving it but only have the 30 days to get permit for new location and build cement pad.
We feel we need more time to save shed or chance to appeal the dyke, right next to our own property which will look right into house.
Do we have any rights with shed & time frame or with dyke invading privacy of home?
