    Default Paternity

The law will vary by state. Typically your husband would be the presumed father, and would normally be named on the birth certificate at the child's father. If he is not the father, it should be possible to nonetheless leave him off. The omission of a father from the birth certificate may leave you subject to the possibility of a paternity suit brought by the biological father. You should also pursue a paternity action at a later date to add the biological father, or to do so following the execution of an affidavit of parentage by the biological father.
