    Default T-Intersection Accident

    My question involves a traffic accident in the State of: South Dakota

    I need advice please on an argument I am to make in a small claim court.

    I was hit on the driver's side when I was turning on a T-intersection. I was driving on the major road of the T and I was turning left into the minor road of the T. The other driver did not yield and rolled into my car(the impact point is the middle of the driver's door) in the middle of the intersection because she was looking the other way. I don't want to say that I saw her looking the other way the split second before the accident because they might say I wasn't paying attention. Since my insurance doesn't handle the claim and she had an insurance agent. they decided it wasn't anyone's fault. The other driver spinned it around and said that I cut her off when the accident happened, eventhough the impact was in the middle of the intersection(so it was on my road not hers.) Please, can someone give me advice.

    Before we can give an appropriate response, we need more information about the intersection. Specifically, what traffic control devices are in place? Three-way STOP, flashing lights, traffic lights, STOP only for the minor road, etc.

    And what do you mean, "my insurance doesn't handle the claim"? Why won't your insurance company handle the claim? Plus, you said, "they decided it wasn't anyone's fault." Who's THEY?

    Sorry for the lack of information. There are no traffic control devices at the intersection, but since it's a T-intersection...I am assuming that a car coming from the minor road would have to yield to cars in the major road. My insurance company just gave me a letter to send to the other driver...they didn't investigate and decide who's at fault. The other driver's company called both of us and decided it was no one's fault.
